Kentucky’s Requirements for an Uncontested Dissolution of Marriage

Kentucky is a no-fault divorce state under KRS 403.170. The sole ground for dissolution of marriage is that the marriage is irretrievably broken. How Kentucky Divides Marital Property

Kentucky follows equitable distribution under KRS 403.190, which means marital property is divided fairly but not automatically 50/50. Courts weigh each spouse’s contribution to acquiring the property, each spouse’s economic circumstances after the divorce, and other relevant factors. In an uncontested case, the spouses determine how to divide assets and debts through the marital settlement agreement rather than leaving that decision to a judge.

When a Case Can’t Proceed as Uncontested

Not every divorce that starts out cooperative qualifies as uncontested. Understanding the limits helps couples assess their situation honestly before filing.

Common reasons a case doesn’t qualify:

Incomplete financial transparency: An uncontested divorce requires full disclosure of income, assets, and debts from both spouses; without it, neither spouse can make an informed decision about settlement terms
Unresolved disagreements: If the spouses can’t agree on custody, parenting time, child support, or maintenance, the case isn’t uncontested, even if every other issue is settled
One spouse is unreachable: Both spouses must be located and willing to participate; if one spouse can’t be found or refuses to sign, the case can’t proceed on an uncontested basis
