Division of Property in the State of Kentucky
In the state of Kentucky, marital property is divided in “just proportions.” See KRS 403.190. Unlike some Community Property States in the West, this does not necessarily mean everything is divided 50-50. The Division of martial property can depend on how long a couple has been married, the financial and care-giving contributions of each, as well as any other equitable factor.
Regardless of whether you are the primary wage earner or not, the court may base its division of property on the relationship between you and your spouse, the duties of each, and the contributions made to the family. In addition, a Court does not divide non-marital assets. Non-marital assets generally include money you had prior to marriage, gifts, or inheritance you may have received during the marriage. In Kentucky a Court is required to restore these non-martial assets to the appropriate spouse.
